TERMS OF SERVICE

1. Acceptance of Terms

By creating an account or using the 0x12DarkSandbox platform (the "Service"), you agree to be bound by these Terms of Service. The Service is operated by 0x12 Dark Development, a sole trader registered in Spain ("we", "us", "the operator").

2. Service Description

0x12DarkSandbox provides automated dynamic malware analysis. You submit a file; it is executed in an isolated virtual machine environment; behavioral telemetry, static analysis results, and AV detection data are returned to you.

The Service operates on a prepaid credit model. Credits are consumed per analysis job. There are no subscriptions or recurring charges.

3. Account Registration

You must provide a valid email address and complete email verification to use the Service. You are responsible for maintaining the confidentiality of your account credentials and API keys. You must not share your account or API keys with third parties.

We reserve the right to refuse registration or suspend accounts at our sole discretion. See our Abuse Policy for details.

4. Acceptable Use

Use of the Service is subject to our Abuse Policy, which is incorporated into these Terms by reference. By agreeing to these Terms, you also agree to the Abuse Policy.

5. Credits and Payments

Credits are prepaid and non-refundable except where required by applicable consumer law. Credits have no cash value and cannot be transferred between accounts.

If we increase the price of scan packs in the future, your existing credit balance will not be affected — credits already purchased retain their nominal scan value regardless of pricing changes.

In the event of permanent service closure, we will make reasonable efforts to notify users in advance. We cannot guarantee refunds for unused credits upon closure, but will prioritize users holding significant balances.

6. Service Availability

The Service is provided on a best-effort basis. We make no guarantees of uptime, availability, or response time. Scheduled and unscheduled maintenance may result in temporary unavailability without prior notice, though we will endeavor to communicate planned outages.

Credits are not refunded for downtime unless the downtime is prolonged and directly caused a failed or lost analysis job.

7. Analysis Results

Analysis results are provided for informational purposes only. They do not constitute legal, forensic, or expert opinions and carry no legal weight. Detection rates, behavioral telemetry, and threat classifications may be incomplete, inaccurate, or subject to false positives and false negatives.

You are solely responsible for any decisions or actions taken based on analysis results.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose, merchantability, or non-infringement. We do not warrant that the Service will be error-free, uninterrupted, or free of harmful components.

9. Limitation of Liability

To the maximum extent permitted by applicable law, 0x12 Dark Development shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Service. Our total liability for any claim shall not exceed the amount you paid for credits in the three months preceding the claim.

10. Changes to the Service and Terms

We reserve the right to modify or discontinue any aspect of the Service and to update these Terms at any time. We will make reasonable efforts to communicate material changes through the platform's announcement system or by email. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

11. Termination

You may close your account at any time by contacting support. We reserve the right to suspend or terminate your account for violation of these Terms or the Abuse Policy, with or without notice.

Upon termination, your data is retained for 7 days and then permanently deleted, as described in our Privacy Policy.

12. Governing Law and Disputes

These Terms are governed by the laws of the Kingdom of Spain. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Barcelona, Spain.
